    The Construction Law program aims to impart knowledge about the facets of contract law relevant to the construction industry. Participants will acquire pragmatic skills, learning to tackle conflicts efficiently and prevent legal disputes.     COURSE OVERVIEW

    The Construction Law program aims to impart knowledge about the facets of contract law relevant to the construction industry. Participants will acquire pragmatic skills, learning to tackle conflicts efficiently and prevent legal disputes. The curriculum also covers a comprehensive review of other laws associated with construction, including builders liens, debt collection, bonding, insurance, environmental law, and safety law.

    Upon successful completion, this course qualifies for 5 CCA Gold Seal education credits and 10 BC Housing CPD credits.

    COURSE TOPICS

    The Construction Law program comprises 12 instructive video modules, totaling 10 hours of expert-led content.

    • Exploration of the Canadian legal system and law sources
    • Primer on contract law basics – intention, offer, acceptance, consideration, capacity and legality
    • Introduction to various CCDC/CCA contracts and their applications
    • Understanding of legal jargon used in contracts
    • Comprehension of the contractual duties of different parties
    • Insight into the bidding process and contractual obligations
    • Understanding how specifications and drawings relate to the contractual hierarchy
    • Insight into the contractual bond between contractor and sub-contractor
    • Knowledge on compiling and submitting proper extras and claims
    • Definition of back charges and how to avoid them
    • Skills to prevent construction disputes and claims at the site level
    • Techniques to write professional RFIs and Change Orders
    • Understanding the dispute resolution process – negotiation, mediation, arbitration, and litigation
    • Usage of the Builder’s Lien Act to secure debts
    • Understanding the function and purpose of the “holdback system”
    • Usage of the Small Claims process to recover debts
    • Understanding bonding/surety and its application in construction
    • Insight into the types of insurance used in construction
    • Understanding environmental law
    • Understanding the requirements of safety law and WCB

    PASS MARK

    Testing conducted throughout this online Construction Law course is designed to reinforce the information presented. A mark of 80% must be achieved in order to pass this course. The course is able to be taken three times in efforts to achieve the pass mark. Printable resources are available in the form of a comprehensive student manual. The manual is a valuable resource for future use and knowledge retention.
